  • What Exactly is Workers’ Compensation?

Workers’ compensation is a legal remedy whereby a worker who is injured on the job may be entitled to certain benefits. Benefits may include medical care for the injury, indemnity wage benefits, vocational rehabilitation benefits, and/or death benefits. These different benefits are the obligation of the employer and are paid directly to the employee by the employer or its insurer. Every employer, unless exempt, is responsible for the medical care and the payment of indemnity wage benefits to any employee who is injured while in the course and scope of his employment.

  • The Rights & Responsibilities of Workers

The main obligation of the worker is to report an injury within 30 days. This notice may be submitted by any person who witnessed or was affected by the accident or injury. Louisiana law does state that a claim must be made within the 30-day period, or workers’ compensation benefits would not be recognized.

  • Who is Covered by the Workers’ Compensation?

Most employees are covered under the law from their very first day of employment. In Louisiana, this covers full-time, part-time, seasonal, and minors. There are some exceptions to coverage, which include volunteer workers or those under independent contracts. If you are unsure, you should contact your representative.
